Probate and Estate Tax

Probate is the legal process of settling a decedent’s financial affairs.  In most cases, a personal representative or executor is appointed by the Courts and charged with the responsibilities of paying a decedent’s debts and expenses, assembling all assets and distributing them to the beneficiaries.  For those not familiar with the process, it can be a difficult maze to navigate.  Our attorneys will assist you in all aspects of estate administration, from the initial act of entering a will for Probate, to identifying and accumulating assets and debts, properly accounting for all activities and making distributions in accordance with the laws of the State.

Estate Taxes

New Jersey residents are subject to at least three different types of estate or “death” taxes:  the New Jersey Inheritance tax, the New Jersey Estate tax and the Federal Estate tax.   Unlike income taxes, death taxes are assessed against all assets held by an individual at the time of their death.  In many cases, a decedent’s property cannot be transferred until the proper estate taxes are paid and waivers are obtained by the State.    Our staff will assist you in assembling taxable items, and will prepare and file all required forms on your behalf.

Income Taxes

In addition to estate taxes, the estate representative is also responsible for filing income tax returns for both the deceased individual and for the estate.  We have on staff Enrolled Agents authorized to practice before the IRS with experience is all aspects of income tax and tax return preparation, from simple 1040 returns to more complex returns for estates, businesses and all varieties of Trusts.
